Important NSA ruling on DPS fees. Difficult family relationships do not exempt from the obligation to pay

Zagadnienie prawne: Can the conduct of a resident of a social care home, arising from an illness that deprives him of conscious control over his own behaviour, constitute "gross violation of family obligations" justifying the release of relatives from payment for the stay in the care home under Article 64(7) of the Act on Social Assistance. Podstawa prawna: Article 64(7) of the Act on Social Assistance provides (in line with the information conveyed in the message and the general principle arising from that provision) that persons on whom the obligation to pay for a stay in a care home rests, or who already bear such payments, may be granted a partial or full release from the fees if the resident of the facility grossly violated family obligations. The amendment in force since 4 October 2019 (and the subsequent 2021 changes) further indicates that an application for release may be filed both by persons actually bearing the costs and by those on whom the payment obligation has not yet fallen due, and the purpose of the regulation is to protect relatives from financing the stay of persons who previously harmed them. Since the sources provided do not contain the full text of the provision, the reasoning is based on the wording of the regulation as set out in the case description and on the general principle that the ground for release is a culpable, conscious violation of family obligations by the resident, not the mere objective conduct. Co mówi orzecznictwo: In the case at hand, the administrative case-law has developed uniformly: the Social Insurance Chamber of Appeal (SKO), the Voivodeship Administrative Court in Olsztyn and, ultimately, the Supreme Administrative Court (NSA) held that the key criterion is the conscious character of the behaviour or the deliberate omission, not its consequences for the family. The NSA expressly acknowledged that gross violation of family obligations may include physical violence, verbal abuse, humiliation, provoking quarrels or complete disregard for the fate of one's closest relatives; however, in this case the son's illness deprived him of the ability to consciously control his conduct and to understand its consequences, which precluded the fulfilment of the statutory condition. The judgment became final and consolidates the conclusion that even very difficult family relationships do not automatically exempt one from the fees. Znaczenie praktyczne: The argument that "the family experienced violence" is, at present, in itself insufficient — the applicant must prove the resident's culpability or awareness, and where the aggression stems from a mental illness or a chronic condition, the application for release from fees is likely to fail. A further practical risk is an increase in the co-payment in the course of the relief proceedings, as happened in this case (application filed in March 2023, refusal in July 2023); therefore, before filing an application, one should assess whether there is evidence of a conscious, deliberate violation of family obligations (e.g. records of interventions, judgments, expert opinions), rather than mere accounts of aggressive behaviour. At the same time, it is worth taking advantage of the possibility, confirmed by the NSA, of applying for release even before the payments begin — there is no need to wait until the payment obligation becomes due.

New Rules for Care Allowance from 24 October 2026 – What Has Changed?

Zagadnienie prawne: Is an application for a care allowance submitted in electronic form (e.g. by e-mail) valid without additional signature requirements, depending on whether the benefit payer is the employer (principal) or the Social Insurance Institution (ZUS). Podstawa prawna: I rely on the general rule arising from Article 61^b of the Act on Cash Benefits from Social Insurance in the Event of Sickness and Maternity (consolidated text promulgated by the Marshal of the Sejm's announcement of 19 June 2026), under which an application for the benefit may be submitted in paper form or in the form of an electronic document signed with a qualified electronic signature, a signature confirmed by the ePUAP trusted profile, or another appropriate electronic signature. The provision does not establish a single, uniform procedure for all cases — the wording of the visible part of the norm ties the electronic form to the requirement of an appropriate signature, which means that a mere e-mail containing an unsigned scan of the application is not fully equivalent to a paper application. A new regulation of the Minister of Family, Labour and Social Policy of 27 September 2026 (which entered into force on 24 October 2026) standardised the application form into a single Z-15 form, replacing the previous Z-15a and Z-15b forms, and specifies the scope of information and documents necessary for the grant of the benefit. Sprostowanie: The report presents an incomplete claim that the application "can be submitted even by e-mail" and that the payer may request the original. It omits the key condition arising from Article 61^b of the benefits Act: in proceedings before ZUS, an application submitted in electronic form must bear a qualified electronic signature, a signature confirmed by the ePUAP trusted profile, or another appropriate electronic signature — an unsigned e-mail alone does not meet the statutory requirements. A more precise formulation would therefore be: the application may be submitted in paper or electronic form, with the electronic form requiring an appropriate signature (in particular where ZUS is the payer), and the payer may additionally request that the application together with its annexes be submitted in original. Znaczenie praktyczne: When submitting applications directly to ZUS (e.g. where the employer reports more than 20 insured persons and is not a benefit payer), a qualified signature or trusted profile should be applied immediately — otherwise ZUS will call for the formal deficiencies to be remedied, which delays the payment date of the benefit. The argument of "freedom of form" based on the regulation alone is weaker than the express signature requirement in Article 61^b of the Act, which is a provision of higher rank and settles the question of the validity of the application. Moreover, as of 24 October 2026, only the standardised Z-15 form should be used — submitting an application on the old Z-15a or Z-15b form exposes the claimant to a call to file a correct application, although it does not deprive them of the right to the benefit if it has taken effect within the meaning of the provisions on the processing of applications by the payer.

Important Step for PKP Cargo Group. PKP Cargotabor Restructuring Agreement Legally Approved

Zagadnienie prawne: When does an arrangement concluded in restructuring (sanation) proceedings become effective vis-à-vis creditors and the company, and what legal effects does the final approval of the arrangement by the court produce (termination of the proceedings and transition to its implementation)? Podstawa prawna: The sources provided contain no direct statutory provision, so I rely on the general principle of restructuring law (the Act of 15 May 2015 — Restructuring Law). An arrangement requires a two-stage "closure": after the acceptance of the arrangement by the creditors has been established (here: on 10 September 2026 by the judge-commissioner), the judge-commissioner approves the arrangement, and that ruling becomes effective upon the expiry of the time limit for filing a complaint against the ruling or after the complaint has been examined — only finality (here: on 24 October 2026, confirmed by an order of the court referendary of 26 October 2026) opens the phase of implementation of the arrangement. As of the date of the final approval of the arrangement, the court terminates the proceedings, and the modifications set out in the arrangement (reductions, deadlines, write-offs) bind the creditors covered by the arrangement, even those who voted against — here 21 out of 271 entitled creditors. Co mówi orzecznictwo: In the practice of restructuring courts, a complaint against the ruling approving the arrangement is filed within a one-week time limit, and finality is usually reached without a complaint — as confirmed by the course of events in this case (approval in mid-October, finality on 24 October 2026). The case law confirms that voting against does not protect a creditor from the effects of the arrangement, provided the creditor was properly included in the list of creditors and no substantive defect in the voting is demonstrated. Znaczenie praktyczne: The procedural risk now shifts from the approval phase to the implementation phase: any disputes concerning the amounts and deadlines of repayments will be resolved on the basis of the content of the arrangement, and a creditor who considers that repayment is being performed defectively should resort to the remedies available under the implementation of the arrangement (including revocation of the arrangement), rather than challenging the already final ruling approving it. For the company itself, it is significant that a breach of the repayment schedule under the arrangement may constitute grounds for a creditor's motion to revoke the arrangement, which in practice means the reopening of bankruptcy risk — hence the idea communicated by the supervisor of the sanation estate of "timely performance of obligations" has not only a business but precisely a legal dimension. It would also be an error to continue settling claims according to their original state — as of the date of termination of the proceedings, only the content of the arrangement applies, including for creditors who voted against in the ballot at the end of August 2026.
