Analysis

Correction. The wording of the statutory criteria concerning “not owning real estate by right of ownership” must be read together with the exception. Under the relevant procedural rules, a family may own a dwelling if it meets the criteria of 14 sq. m per person or shows depreciation of more than 60%. It would be more precise to say that owned housing generally excludes entitlement, except in cases of unsuitable housing provided for in the law and the related housing support regime. It is also necessary to refer at the same time to the EUR 120,000 value and price threshold for the home being acquired under Article 5 of the Law on Financial Incentives. The statement concerning an “additional subsidy” upon the birth of a third child must be distinguished from the additional child benefit provided for in Article 6 of the Law on Child Benefits.

Under Article 3(2), the subsidy is calculated on the amount of the housing loan, capped at EUR 87,000.
Under Article 7, within six months from acquisition of ownership, all family members must declare their place of residence in the acquired dwelling.

That question is determined under Articles 1, 3, 4, 5, 6 and 7 of the Law on Financial Incentives for Young Families Acquiring Their First Home.

Legal assessment

Under Article 1(1) of the Law on Financial Incentives for Young Families Acquiring Their First Home, the incentive is intended for the acquisition of a first home in the territories of the Republic of Lithuania defined in the law. Under Article 1(2) of the same law, each family member must have declared his or her place of residence or be included in the register of persons who have not declared a place of residence. Under Article 5(1), several cumulative requirements are assessed:

  • at the time of submitting the application, the family must meet the definition of a young family;
  • the family members must not own housing in Lithuania or abroad;
  • previous or existing housing is not an obstacle only where it satisfies the criterion of 14 sq. m per person or has depreciation exceeding 60 per cent;
  • the dwelling to be acquired must not fall within the territories excluded by the law and the description;
  • the value of the dwelling to be acquired and the purchase price under the sale-purchase agreement must not exceed EUR 120,000.

The territorial filter is strict, because the description excludes municipalities with more than 150,000 inhabitants, certain surrounding municipalities, and resorts. In surrounding municipalities, it is additionally verified whether the normative value per unit of apartment-building area exceeds the municipal average. Under Article 3(1), the subsidy is granted only to a young family that has obtained a certificate and is taking out a housing loan to purchase its first home. The subsidy rates are as follows:

  • 10 per cent of the loan amount where the family has no children or is raising one child;
  • 12.5 per cent of the loan amount where the family is raising two children;
  • 15 per cent of the loan amount where the family is raising three or more children.

Under Article 4(1) and (2), the programme is financed from the state budget and implemented according to the appropriations for the relevant year. Under Article 4(3), the state incentive may be combined with support from a municipality or a profit-seeking legal person. In such a case, the combined share of the incentive and support may not exceed 50 per cent of the value of the dwelling being acquired. Procedurally, the family applies to the administration of the municipality in whose territory it intends to acquire its first home. This is established by Article 6(1), which links the application to the current-year appropriations of the Ministry of Social Security and Labour for issuing certificates. Under Article 6(2), the family is not required to submit additional documents that the municipality obtains itself.

Consequences

In practical terms, for some families the decisive factors will be not only age or number of children, but also the location and value of the dwelling, previous property, and budget appropriations. A family seeking to acquire a dwelling of excessive value, a dwelling in a resort, or a dwelling in an ineligible municipality would not receive a certificate under these provisions. After receiving the subsidy, continuing obligations arise under Article 7:

  • to provide complete and accurate information in the application;
  • the residence-declaration period must be no shorter than five years from acquisition of ownership;
  • if the dwelling is transferred within the first five years, the subsidy must be repaid to the credit provider;
  • if the loan is repaid early, then in the event of transfer the subsidy must be repaid to the Ministry of Social Security and Labour or its authorised institution.

The maximum subsidy base is EUR 87,000, so a 10 per cent subsidy would amount to up to EUR 8,700. Correspondingly, a 12.5 per cent subsidy would amount to up to EUR 10,875, and a 15 per cent subsidy to up to EUR 13,050.

Roots — who shaped this rule and why:

The regulation was initiated by the Government in implementation of its programme commitment to assist young families in acquiring their first home outside major cities. The aim was to establish a financial incentive mechanism for young families under the age of 35, irrespective of their income, and thereby encourage home acquisition in the regions. No principal objections are apparent from the materials submitted; the measure was justified by reference to the provisions of the Government Programme and its implementation plan.

Analysis

Correction. The article’s statement regarding the additional annual non-taxable amount of EUR 1,044 is incomplete because it omits the proportional reduction rule. It would be more accurate to say that EUR 1,044 is the maximum additional annual child-related non-taxable amount, but that it is reduced where annual employment-related income does not reach 12 minimum monthly wages. The statement that maternity benefit will be paid for four months irrespective of the week of pregnancy is also too broad. Under Article 17 of the Law on Sickness and Maternity Social Insurance, cases involving 30 or more weeks of pregnancy must be distinguished from births occurring between 22 and 30 weeks, because the law sets out separate conditions for them.

Under point 1 of the Government Resolution “On the Minimum Wage Applicable in 2027”, in 2027 the minimum hourly wage will be EUR 7.61 and the MMA will be EUR 1,245.
Under Article 20(2)(1) of the Law on Personal Income Tax, the monthly NPD is EUR 747 where monthly employment income does not exceed the MMA in force on 1 January.

Core issue

From 1 January 2027, the legal position of low-income employees will change through three channels: the minimum wage, the non-taxable income amount (NPD), and the social insurance contribution base. A less visible impact will fall on employers, since for some of them not only wages but also the burden of mandatory contributions will increase. The legal question is what mandatory labour and social insurance minimum employers will have to ensure in 2027 and how it will affect the employee’s taxation. It is resolved under point 1 of the Government Resolution “On the Minimum Wage Applicable in 2027”, Article 10(1) of the Law on State Social Insurance, and Article 20 of the Law on Personal Income Tax.

Legal assessment

The same resolution was adopted pursuant to Article 141(3) and (4) of the Labour Code, meaning that the MMA is not a matter of employer discretion. Employers’ obligations from 2027 will be specific:

  • to pay no less than EUR 7.61 per hour or EUR 1,245 per month where the full MMA applies;
  • to calculate social insurance contributions on an amount of remuneration not lower than the MMA or minimum hourly wage (MVA) approved by the Government;
  • to assess working time proportionately, as expressly required by Article 10(1) of the Law on State Social Insurance. This provision covers not only the base salary but also additional earnings. The base includes bonuses, supplements, payment for night work, overtime work, work on rest days and public holidays, and on-call duty. For the employee, Article 20 of the Law on Personal Income Tax is relevant in relation to personal income tax. Under paragraph 1 of that article, the annual non-taxable income amount (MNPD) may not exceed EUR 8,964 where annual income does not exceed twelve times the MMA in force on 1 January. This means that in 2027 the MMA amount will operate both as the minimum wage threshold and as a threshold for calculating the NPD. If annual income exceeds twelve times the MMA, the MNPD will decrease according to the formula: 8,964 – 0.49 × the excess income. Therefore, the EUR 1,245 MMA will mean not only a EUR 92 gross increase, but also a new threshold for the annual NPD test. As regards self-employed persons, the sources provided indicate a different logic. The amendment to Article 9(5) of the Law on State Social Insurance provides for monthly payment of contributions by the last day of the current month for certain groups. For farmers and their partners, the provision links the minimum contribution base to the MMA where income is not subject to personal income tax.

Consequences

In practice, in January 2027 employers will have to recalculate the minimum amounts applied in employment contracts, accounting, and contribution declarations. If an employee receives the MMA, the gross amount will have to reach EUR 1,245, and the hourly minimum will be EUR 7.61. The significant consequences for employers will be as follows:

  • the wage fund will increase at least for those employees whose remuneration is below the new minimum;
  • the social insurance contribution base may not be lower than the MMA or MVA, recalculated according to time worked;
  • in collective agreements, social partners are recommended to set amounts higher than the minimum approved by the Government. For employees, the consequences will depend on whether their income remains at the MMA threshold. According to the factual statement in the news item provided, projected net income could increase by approximately EUR 56, but the legal formula is based on the MNPD and NPD rules in Article 20 of the Law on Personal Income Tax. As regards parental relief, the legal sources provided directly support only the general NPD regulation under Article 20 of the Law on Personal Income Tax. The additional annual NPD of EUR 1,044 and the EUR 208.80 credit mentioned in the news item will in practice be relevant when declaring 2027 income in 2028.

Under Article 12 of the law, their legal status is determined by international agreements on the status of armed forces, agreements based on them, and Lithuanian legal acts.
If Lithuania perceived a direct threat, the first legal step would be a request for NATO consultations under Article 6 of the Law on the Basics of National Security.

Core issue

For Lithuania, this matter is not merely a question of trust, but a defence regime already embedded in law. The central point is that, under Lithuanian law, NATO assistance is linked to national defence, decisions of the Seimas, and the reception of allied forces. The precise question is how Lithuania would act legally if it perceived a direct threat or suffered an armed attack, and how allies would be involved. This is governed by Article 6 of the Republic of Lithuania Law on the Basics of National Security, Article 5 of the Law on International Operations, Exercises and Other Military Cooperation Events, as well as Articles 4, 12 and 16 of that law. The content of the NATO commitment is defined in the sources as follows: an armed attack in Europe or North America is considered an attack against all, and assistance is provided by taking such action as is necessary, including the use of armed force.

Legal assessment

Article 6 of the Law on the Basics of National Security bases Lithuania’s defence system on the principle of universal and unconditional defence, implemented together with NATO collective defence. Under this provision, the State must act on several levels:

  • preparedness of citizens for defence and resistance;
  • preparedness of the armed forces for unconditional defence;
  • military defence, partisan action, civil disobedience and non-collaboration;
  • an immediate request for NATO consultations where a direct threat is perceived to territorial integrity, political independence or security;
  • a request for armed assistance where an armed attack occurs. Article 5 of the Law on International Operations, Exercises and Other Military Cooperation Events establishes a reciprocal collective defence mechanism. Lithuanian military units may depart for the territories of allied states, while allied military units, servicemembers, civilian personnel and contractors may enter Lithuania. The centre of decision-making under Lithuanian law is clear: under Article 5(2), the decision is taken by the Seimas on the proposal of the President of the Republic. Article 16 of the law links this regime to the entry into force of the North Atlantic Treaty for Lithuania. Article 4 of the law supplements this regime with the procedure for international operations. Once decisions on Lithuania’s participation have been adopted, Lithuanian military units may be placed under the operational command and control of other states, the United Nations, NATO or European Union institutions. The consolidated EU and European Community founding treaties state that Union policy respects the obligations of Member States under the North Atlantic Treaty and is compatible with NATO security and defence policy.

Consequences

The practical consequence for Lithuania is twofold: the State must prepare for independent defence while also keeping open the path for the involvement of allied forces. Political doubts regarding the United States’ posture do not alter Lithuania’s duty, established in the sources, to plan defence in accordance with national and NATO collective defence plans. If an armed attack occurred, Lithuania would immediately request armed assistance under the same article. The subsequent practical decisions would be as follows:

  • the President of the Republic would submit to the Seimas a decision on the departure of forces or the arrival of allied forces;
  • the Seimas would decide by resolution under Article 5(2) of the Law on International Operations;
  • the national defence system would organise the conditions of participation and operational command under Article 4;
  • the status of arriving allies would be determined under Article 12 and the applicable international agreements. This is practically significant for the armed forces, mobilisation planners, the host-nation support system and citizens whose preparedness is incorporated into the universal defence model.
Roots — who shaped this rule and why:

The regulation was initiated by drafters in the field of national defence, and the proposals were refined by the Committee on National Security and Defence. The aim was to expedite decisions concerning exercises by NATO and EU troops in Lithuania by assigning them to the Minister of National Defence, as parliamentary procedures were considered too slow for implementing NATO readiness measures. The principal argument was the more effective fulfilment of allied security commitments and cooperation, and no clear objections appear in the texts submitted; some of the other amendments relate to the issue only indirectly, through the regulation of international operations and the national defence system.

Šis principas įtvirtinamas įstatymuose, kituose gynybą reglamentuojančiuose teisės aktuose, kariuomenės bei jos aktyviojo rezervo parengimo gynybai planuose ir kituose dokumentuose. Šiuo principu taip pat grindžiamas piliečių mokymas ir rengimasis gynybai bei pasipriešinimui. Visuotiniu piliečių pasirengimu pasipriešinimui ir ginkluotųjų pajėgų pasirengimu besąlygiškai gynybai nuo agresijos, įgyvendinamai individualiai ir kartu su NATO sąjungininkų pajėgomis, Lietuva siekia atgrasinti kiekvieną potencialų užpuoliką. Lietuva priešinsis agresoriui visomis jai prieinamomis priemonėmis: karine gynyba ir partizaniniais veiksmais, civilių piliečių nepaklusnumu, nekolaboravimu bei kitais būdais. Lietuva neatidėliodama prašo NATO konsultacijų, kai jaučia tiesioginę grėsmę savo teritoriniam vientisumui, politinei nepriklausomybei ar saugumui. Būdama Šiaurės Atlanto sutarties ir kitų Europos valstybių kolektyvinės gynybos sutarčių dalyvė, Lietuva ginkluoto užpuolimo atveju nedelsdama kreipiasi šių sutarčių šalių ginkluotos pagalbos užpuolimui atremti. Lietuva rengiasi gynybai remdamasi šiuolaikiniu karybos mokslu ir tautos dešimtmete pokario partizaninės kovos prieš Sovietų Sąjungos kariuomenę ir okupacinį režimą patirtimi. Agresijos faktą Lietuva konstatuoja vadovaudamasi tarptautinės teisės normomis. Agresijos ar kitu prievartos prieš Lietuvos valstybę atveju piliečiai ir jų susivienijimai priešinasi bet kam, kas prievarta kėsinasi į Lietuvos nepriklausomybę, teritorijos vientisumą ar konstitucinę santvarką. Kiekvienam pasipriešinimo dalyviui taikomas kombatanto statusas pagal tarptautinės teisės aktus. Tautos ir valstybės gynybai vadovauja laisvai ir teisėtai veikiančios valstybės institucijos, o jei jos negali veikti, - Tautos sukurtos arba jos pripažįstamos vadovavimo pasipriešinimui institucijos.

Įgyvendinant Lietuvos Respublikos teises ir įsipareigojimus pagal kolektyvinės gynybos sutartį: 1) kolektyvinės gynybos operacijos tikslais Lietuvos Respublikos kariniai vienetai, kariai ir civiliai krašto apsaugos sistemos tarnautojai gali išvykti į kitas valstybes ir būti panaudoti kitų valstybių teritorijose; 2) kolektyvinės gynybos operacijos tikslais kitų valstybių – Lietuvos Respublikos sąjungininkių – kariniai vienetai, kariai ir karinėms pajėgoms priskirti civiliai tarnautojai bei rangovai gali atvykti į Lietuvos Respubliką ir būti panaudoti Lietuvos Respublikos teritorijoje. 2. Lietuvos Respublikos, kitos arba kitų kolektyvinės gynybos sutarties šalių ginkluoto užpuolimo atveju Respublikos Prezidentas nedelsdamas priima sprendimą dėl gynybos nuo ginkluotos agresijos, įskaitant sprendimą dalyvauti kolektyvinės gynybos operacijoje, prireikus išsiųsti ir panaudoti Lietuvos karinius vienetus, karius ir civilius krašto apsaugos sistemos tarnautojus kitų valstybių teritorijose, leisti atvykti į Lietuvos Respubliką ir joje panaudoti kitų valstybių karinius vienetus, karius ir karinėms pajėgoms priskirtus civilius tarnautojus bei rangovus ir imtis kitų priemonių, reikalingų kolektyvinės gynybos operacijos tikslams pasiekti. 4. Šio straipsnio 3 dalyje nurodytas Respublikos Prezidento sprendimas turi būti nedelsiant vykdomas. Respublikos Prezidentas teikia šį sprendimą tvirtinti artimiausiame Seimo posėdyje, o tarp Seimo sesijų – nedelsdamas šaukia neeilinę Seimo sesiją. Užtikrindamas Seimo ratifikuotos kolektyvinės gynybos sutarties ir ją įgyvendinančių bendrų šios sutarties šalių sprendimų vykdymą bei ginkluotą gynybą ir pasipriešinimą ginkluotam užpuolimui, Seimas priima nutarimą dėl Respublikos Prezidento sprendimo patvirtinimo. 5. Kitų valstybių teritorijose kolektyvinės gynybos operacijos tikslais naudojamų Lietuvos Respublikos karinių vienetų, karių ir civilių krašto apsaugos sistemos tarnautojų skaičius, dydis ir jų buvimo kitų valstybių teritorijose laikas, taip pat kitų valstybių – Lietuvos Respublikos sąjungininkių – karinių vienetų, karių ir karinėms pajėgoms priskirtų civilių tarnautojų bei rangovų skaičius, dydis ir jų buvimo Lietuvos Respublikos teritorijoje laikas nustatomi pagal Lietuvos Respublikos ir kitų kolektyvinės gynybos sutarties šalių ar kitų Lietuvos Respublikos sąjungininkių sutartis ar susitarimus bei bendrus kolektyvinės gynybos sutarties šalių sprendimus.

Pagal Lietuvos Respublikos tarptautinę sutartį ar susitarimą gali būti steigiami bendri su NATO, Europos Sąjungos ir Vakarų Europos Sąjungos bei kitomis valstybėmis kariniai vienetai, skirti dalyvauti tarptautinėse operacijose. Bendriems su užsienio valstybėmis kariniams vienetams priskirtų Lietuvos Respublikos karinių vienetų sudarymo, finansavimo ir parengimo tarptautinėms operacijoms tvarką nustato Lietuvos Respublikos tarptautinės sutartys ar susitarimai dėl šių vienetų steigimo ir Lietuvos Respublikos Vyriausybė. 4. Bendrų su užsienio valstybėmis karinių vienetų panaudojimo sąlygas ir jų operacinio vadovavimo bei kontrolės tvarką, taip pat Lietuvos karių ir civilių krašto apsaugos sistemos tarnautojų skaičių šiuose vienetuose nustato Lietuvos Respublikos tarptautinės sutartys ar susitarimai dėl bendrų karinių vienetų steigimo. 5. Į tarptautinių operacijų karinį vienetą savanoriškumo pagrindu priimami profesinės karo tarnybos kariai, kariuomenės aktyviojo rezervo prievolininkai ir individualiajam rezervui priklausantys asmenys. Su priimamaisiais sudaroma profesinės karo arba civilinės krašto apsaugos tarnybos sutartis ir tarnybos tarptautinių operacijų kariniame vienete sutartis. Taip pat gali būti priimami parengti dalyvauti tarptautinėse operacijose privalomosios pradinės tarnybos kariai. Su jais sudaroma tarnybos tarptautinių operacijų kariniame vienete sutartis, o pasibaigus privalomajai pradinei tarnybai, – profesinės karo tarnybos sutartis. 6. Lietuvos karių ir civilių krašto apsaugos sistemos tarnautojų tarnybos tarptautinių operacijų kariniuose vienetuose sąlygas nustato Lietuvos Respublikos Vyriausybė. 7. Kolektyvinės gynybos operacijoms vykdyti gali būti panaudojami visi Lietuvos Respublikos kariniai vienetai, netaikant jų sudarymui šio straipsnio 5 dalyje numatytų sąlygų.
